These Terms and Conditions govern the offer and sale of products through the website igiardinidigiulia.it. Please read them carefully before making a purchase. By placing an order, you fully accept the conditions described herein, drafted in accordance with the Consumer Code (Legislative Decree 206/2005), Legislative Decree 70/2003 on electronic commerce, and EU Directive 2011/83/EU.

1. Subject of the Contract

The contract concerns the distance selling of physical products belonging to the following categories:

• Live Plants: indoor plants, bonsai, tillandsia, rare plants, kokedama, hydroponics.
• Preserved Greenery: moss frames and compositions.
• Terrariums and Kits: glass ecosystems and DIY kits.
• Accessories: pots, plant care tools, and furnishing accessories.
• Events and Business: green wedding favors (standard and personalized) and corporate gifts.

The images and descriptions on the website are as accurate as possible. However, as many products are natural and living, each plant is unique: slight variations in shape, color, or size compared to the photos are completely normal and attest to the product's authenticity.

2. Purchase Procedure and Contract Conclusion

Shopping on our website is simple and secure:

1. Add the desired products to your cart.
2. Go to the checkout page, where you can review your order summary, including shipping costs.
3. Enter your billing and shipping information.
4. Choose your payment method and confirm your order.

The sales contract is concluded when you receive an order confirmation email from us, containing the order summary, order number, and shipping details. We reserve the right not to accept orders in case of product unavailability or for other legitimate reasons, in which case we will immediately refund any amount already paid.

3. Prices and Payment Methods

All prices indicated on the website are in Euros (€) and are inclusive of VAT and all other applicable taxes. Shipping costs are not included in the product price but are calculated and clearly displayed in the cart before the order is concluded.

To ensure maximum security and convenience, we offer various traceable payment methods protected by advanced encryption systems:

• Credit/Debit Cards: Visa, Mastercard, Maestro, American Express, Union Pay.
• Digital Systems: PayPal, Apple Pay, Google Pay, Bancontact, iDEAL Wero.
• Installment Payments: via Klarna or PayPal (subject to service provider approval).

4. Shipping and Delivery

We understand how important it is to receive your plants in perfect condition. For this reason, we entrust our shipments to selected express couriers and use custom-designed packaging to protect each product during transit.

• Processing times: Orders are generally prepared and handed over to the courier within 24/48 business hours from confirmation.
• Delivery times: Delivery usually takes 24/48 hours from the time of shipment (times may vary for islands or remote areas).
• Costs: Shipping is free for orders over € 69.00. For smaller orders, the cost will be calculated at checkout.

The risk of loss or damage to goods transfers to you when you physically take possession of the products. If the package shows obvious damage upon delivery, please accept it "with reservation" or refuse it, and contact us immediately.

5. Right of Withdrawal and Returns

Pursuant to Article 52 of the Consumer Code, you have the right to withdraw from the contract within 14 days of receiving the products, without providing any reason, for all non-perishable goods (e.g., pots, accessories, preserved greenery, non-personalized wedding favors).

However, your satisfaction is our priority. That's why we offer a special "Satisfaction Guaranteed" Warranty even on live plants in case of problems upon arrival.

6. Legal Guarantee of Conformity

All non-perishable products sold on our website are covered by the 24-month Legal Guarantee for defects of conformity, pursuant to Articles 128 et seq. of the Consumer Code. If you receive a defective product or one that does not conform to the description, you have the right to have the product brought into conformity by repair or replacement, at no cost to you.

The warranty does not cover damage caused by improper use, negligence, or normal wear and tear of the product. For live plants, being perishable goods, the warranty applies to the conditions in which the product is delivered (see our "Satisfaction Guaranteed" Warranty).

7. Limitation of Liability

I Giardini di Giulia S.r.l. undertakes to ensure the utmost care in the selection, packaging, and shipping of products. However, we cannot be held responsible for service disruptions or delays attributable to force majeure (e.g., strikes, extreme weather events, pandemics) or courier service disruptions that prevent the order from being executed within the expected timeframe.

In no event shall our liability exceed the total value of the order placed by the customer.

8. Intellectual Property

All content on the website igiardinidigiulia.it, including texts, photographs, graphics, logos, trademarks, videos, and layout, are the exclusive property of I Giardini di Giulia S.r.l. or their respective owners, and are protected by copyright and intellectual property laws.

Any reproduction, modification, distribution, or unauthorized use of such content without our prior written consent is strictly prohibited.

9. Privacy and Processing of Personal Data

The protection of your privacy is fundamental to us. Your personal data is collected and processed in full compliance with Regulation (EU) 2016/679 (GDPR) and current Italian legislation, exclusively to manage your orders and offer you the best possible service.

10. Applicable Law, Competent Court, and ODR

These Terms and Conditions are governed by Italian law. For any dispute relating to the validity, interpretation, or execution of these contracts:

• If you are a Consumer: the mandatory territorial jurisdiction is that of the court of your place of residence or domicile, if located within the territory of the Italian State.
• If you are a Business Customer (with VAT number): the exclusive competent court is the Court of Trani.

Furthermore, we inform you that the European Commission provides a platform for alternative out-of-court resolution of online disputes (ODR platform), accessible at http://ec.europa.eu/consumers/odr.

11. Changes to the Terms and Conditions

We reserve the right to update or modify these Terms and Conditions at any time, to adapt them to new legal provisions or to improve our services. The changes will be effective from the moment they are published on this page. Orders already placed will be subject to the conditions in force at the time the contract was concluded.
